Your Education Rights

  • SEND means Special Educational Needs and Disabilities. If you need extra help to learn or join in, you may have SEND. Areas of need: Communication & Interaction, Learning, Mental Health, Sensory or Physical.

  • ✔ Learn in a school, college & University that includes everyone.

    ✔ Schools must make sure you can access extra help- reasonable adjustments (Equality Act 2010).

    ✔ You and your family must be involved in decisions.

    ✔ You can get an Education, Health and Care Plan (EHCP) if you need more help.

    ✔ Help when moving to college, training, or work.

    ✔ Protection from discrimination (Equality Act 2010).

What is a EHCP?

  • An Education, Health and Care Plan (EHCP) is a legal document for children and young people aged 0-25 with special educational needs and disabilities (SEND)

    • It describes their educational, health, and social care needs and the support they require

    • It involves input from various agencies and practitioners

    • The Special Educational Needs Statutory Assessment and Provision (SENSAP) team in Leeds oversees all EHCPs and assessments

  • An Individual Education Plan (IEP) is a document that helps teaching staff plan for your child, including learning strategies, progress monitoring, and access to the curriculum. It is based on your child's profile, records, assessments, strengths, and SEN statement, if applicable.

    • Individual education plans are unique to each child

    • It outlines what and how the child will be taught and the frequency of teaching

    • It must include short-term targets and extra support to help the child achieve them

    • The document should be easy to understand and agreed upon by both the parent and, if possible, the child

  • The first step is to talk with the SENCO teacher at your school, college, or sixth form. You can still apply to the local authority if the school does not support you.
